Terms of Service

Welcome to TexTune! These Terms of Service (“Terms”) govern your use of the TexTune mobile application (“App”) and any related services provided by us (“we,” “us,” or “our”).

By downloading, accessing, or using TexTune, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

1. Description of the Service

TexTune is a premium mobile application that allows users to transform short text messages into custom, shareable music tracks. By selecting a specific genre and tone, users can generate a unique mini-song based on their text input, which can then be played in-app or shared via third-party messaging platforms.

2. Access and User Accounts

Anonymous Accounts: To simplify your experience, TexTune automatically creates an anonymous user profile (via Supabase) when you first launch the App. You do not need to manually register an account with a username or password.

Device Responsibility: Because your access is tied to this anonymous profile on your specific device, you are entirely responsible for maintaining the security of your device. We are not liable for any unauthorized access to your App data or subscription if your device is compromised.

3. Subscriptions and Payments

TexTune is a premium, subscription-gated service. There is no free tier for generating songs.

Billing: All purchases, subscriptions, and billing are processed securely through Apple and our payment infrastructure provider, RevenueCat.

Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellations and Refunds:You can manage or cancel your subscriptions at any time by going to your Apple App Store Account Settings after purchase. Because payments are handled by Apple, all refunds are subject to Apple's standard App Store policies. We cannot issue refunds directly.

4. User Content and Acceptable Use

When you type a message to generate a song, you are submitting “User Content.”

Input Limits: Text messages must be between 30 and 200 characters in length to be processed by our generators.

Prohibited Content: You agree not to input text that is:

• Unlawful, harassing, threatening, defamatory, or hateful.
• Sexually explicit, obscene, or promoting violence.
• Infringing on the intellectual property, privacy, or copyrights of others (including uploading existing copyrighted lyrics without permission).

Right to Refuse: We reserve the right to block the generation of songs that violate these Terms.

5. Ownership and Sharing

Your Inputs: You retain all rights to the original text messages you input into the App.

Generated Songs: We grant you a limited, non-exclusive, worldwide, revocable license to use, download, and share the AI-generated music tracks created through TexTune for personal, non-commercial use. You may share these tracks freely with friends and family using the native iOS share sheet (e.g., iMessage, WhatsApp).

Our App: All branding, UI/UX, software code, and underlying technology of TexTune remain the exclusive property of us and our licensors.

6. AI Generation Disclaimer

You acknowledge that the music tracks are generated by artificial intelligence. Because of the unpredictable nature of AI, we do not guarantee that the generated songs will perfectly match your subjective expectations, nor do we guarantee that the output will always be entirely error-free.

7. Disclaimer of Warranties

TEXTUNE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR TEXTUNE SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the “Last Updated” date at the top of this document or by providing notice within the App. Your continued use of TexTune after changes have been posted constitutes your acceptance of the revised Terms.
